The ‘marketplace of ideas’ is an influential metaphor with widespread currency in debates about freedom of speech. We explore a number of ways competition between ideas might be described as occurring in a marketplace and find that none support the use of the metaphor. We suggest that an alternative metaphor, that of the ‘garden of ideas’, may offer more productive insights into issues surrounding the regulation of speech.

Climate engineering (CE), the intentional modification of the climate in order to reduce the effects of increasing greenhouse gas concentrations, is sometimes touted as a potential response to climate change. Increasing interest in the topic has led to proposals for empirical tests of hypothesized CE techniques, which raise serious ethical concerns. We propose three ethical guidelines for CE researchers, derived from the ethics literature on research with human and animal subjects, applicable in the event that CE research progresses beyond computer (...) modeling. The Principle of Respect requires that the scientific community secure the global public's consent, voiced through their governmental representatives, before beginning any empirical research. The Principle of Beneficence and Justice requires that researchers strive for a favorable risk–benefit ratio and a fair distribution of risks and anticipated benefits, all while protecting the basic rights of affected individuals. Finally, the Minimization Principle requires that researchers minimize the extent and intensity of each experiment by ensuring that no experiments last longer, cover a greater geographical extent, or have a greater impact on the climate, ecosystem, or human welfare than is necessary to test the specific hypotheses in question. Field experiments that might affect humans or ecosystems in significant ways should not proceed until a full discussion of the ethics of CE research occurs and appropriate institutions for regulating such experiments are established. Governance theories impact how corporations are run, which in turn impacts societal well-being. This dynamic is commonly accepted, as evidenced by the flood of articles exploring the links between corporate governance and corporate social responsibility (e.g., Hong et al. in J Bus Ethics 136:199–213, 2016). This article supplements current corporate governance theories with Catholic social thought (CST) to address burgeoning societal issues such as the increasing trust gap, income inequality (the compensation gap), and an overemphasis on financial compensation as the (...) primary way to motivate senior managers. The authors propose a shift away from agency theory and stakeholder theory, both of which, with their limited depictions of the motivations of managers, have contributed to excessive executive compensation. Instead, the authors develop an alternative—justice stewardship theory—which integrates organizational justice theory, the principles of stewardship theory, and the insights of 150 years of CST. The public was very supportive of science and science education following the 1957 lauching of the Soviet Sputnik This high level of support is observed again in 1985, presumably because of the relationship of science and technology to economic security. In this paper we explore the intersection of three topics which have historically been singled out for ethical consideration in advertising and marketing: the use of fear appeals, marketing to the elderly, and the marketing of health care services and products. Issues relevant to using fear appeals in promoting health care issues to the elderly are explored with a consumer psychologist's theoretical view of fear appeals. Next the assumption of the elderly market's vulnerability and indicants of social or psychological function (...) which would differentiate the elderly recipients of marketing communications are examined both in terms of function and ethical concerns.Overall, our review of the theoretical underpinnings of fear-based communication and the psychological characteristics does not indicate that the elderly of today are particularlyvulnerable. While the elderly are probably somewhat more dogmatic than younger consumers and perhaps view outcomes from the perspective of their age, there are no indications that their psychological responses to fear-based appeals differ significantly from those of younger consumers. Philosophers who complain about the ‹demandingness’ of morality forget that a morality can make too few demands as well as too many. What we ought be seeking is an appropriately demanding morality. This article recommends a ‹moral satisficing’ approach to determining when a morality is ‹demanding enough’, and an institutionalized solution to keeping the demands within acceptable limits.

Presentism states that everything is present. Crucial to our understanding of this thesis is how we interpret the ‘is’. Recently, several philosophers have claimed that on any interpretation presentism comes out as either trivially true or manifestly false. Yet, presentism is meant to be a substantive and interesting thesis. I outline in detail the nature of the problem and the standard interpretative options. After unfavourably assessing several popular responses in the literature, I offer an alternative interpretation that provides the desired (...) result. This interpretation is then used to clarify the distinction between ‘real change’ from mere variation and temporal relativisation. Reflecting on my solution, I try to diagnose the source of confusion over these issues. Then, building upon Fine’s distinction between ontic and factive presentism, I elucidate what the presentist thesis specifically concerns and how best to formalise it. In the process I distinguish a weak and strong version of the presentist thesis. Finally, I end by drawing out some limitations of the paper. (shrink)

Robert Schofield explores the rational elements of British experimental natural philosophy in the 18th century by tracing the influence of two opposing concepts of the nature of matter and its action—mechanism and materialism. Both concepts rested on the Newtonian interpretation of their proponents, although each developed more or less independently. By integrating the developments in all the areas of experimental natural philosophy, describing their connections and the influences of Continental science, natural theology, and to a lesser degree social and (...) institutional changes, the author demonstrates that mechanistic concepts dominated interpretations from about 1687 to 1740, when they were replaced by materialistic concepts. A revival of the mechanistic approach early in the next century made England a fertile field for ideas on the dynamic interaction of forces. Originally published in 1970. Many in science are disposed not to take biosemiotics seriously, dismissing it as too anthropomorphic. Furthermore, biosemiotic apologetics are cast in top-down fashion, thereby adding to widespread skepticism. An effective response might be to approach biosemiotics from the bottom up, but the foundational assumptions that support Enlightenment science make that avenue impossible. Considerations from ecosystem studies reveal, however, that those conventional assumptions, although once possessing great utilitarian value, have come to impede deeper understanding of living systems because they implicitly depict (...) the evolution of the universe backward. Ecological dynamics suggests instead a smaller set of countervailing postulates that allows evolution to play forward and sets the stage for tripartite causalities, signs, and interpreters—the key elements of biosemiosis—to emerge naturally out of the interaction of chance with configurations of autocatalytic processes. Biosemiosis thereby appears as a fully legitimate outgrowth of the new metaphysic and shows promise for becoming the supervenient focus of a deeper perspective on the phenomenon of life. (shrink)

A renowned scholar investigates the "human crisis" that Albert Camus confronted in his world and in ours, producing a brilliant study of Camus's life and influence for those readers who, in Camus's words, "cannot live without dialogue and friendship. As France--and all of the world--was emerging from the depths of World War II, Camus summed up what he saw as 'the human crisis'. 'We gasp for air among people who believe they are absolutely right, whether it be in their machines (...) or their ideas. And for all who cannot live without dialogue and the friendship of other human beings, this silence is the end of the world.' In the years after he wrote these words, until his death fourteen years later, Camus labored to address this crisis, arguing for dialogue, understanding, clarity, and truth. When he sailed to New York, in March 1946--for his first and only visit to the United States--he found an ebullient nation celebrating victory. Camus warned against the common postwar complacency that took false comfort in the fact that Hitler was dead and the Third Reich had fallen. Yes, the serpentine beast was dead, but "we know perfectly well," he argued, "that the venom is not gone, that each of us carries it in our own hearts." All around him in the postwar world, Camus saw disheartening evidence of a global community revealing a heightened indifference to a number of societal ills. Individuals are often causally inconsequential parts of highly consequential wholes. If each individual is causally inconsequential, and what she does makes no causal difference, we may be inclined to absolve each of causal responsibility for the consequences of what occurs as a result of the larger whole of which each is a part. But there is another form of responsibility – constitutive responsibility. Whatever the causal consequences may be, each individual constitutes part of that whole and each therefore bears responsibility (...) of at least that sort for the whole. (shrink)

Rational choice theories have been falsified by experimental tests of economic behavior and have not been supported by analyses of behavior in the market. Politics is an even less fertile field of application for rational choice theories because politics deals with ends as well as means, thus preventing ends?means rationality; voters have partisan loyalties often ?fixed? in adolescence; political benefits have no common unit of measurement; ?rational ignorance? inhibits rational choices; and there is no market?like feedback to facilitate learning. Research (...) comparing public and private efficiency does not support rational choice. Ironically, while law and business schools are now employing better microeconomic theories, political scientists are taking up rational choice theory, regardless of the disconfirming evidence. Informal justice often is castigated as rough justice, procedurally unauthorized and substantively unrationalized and prone to error. Yet those same features are present, to some extent, in formal justice as well: they do not form the basis for any sharp categorical contrast between formal and informal justice. Furthermore, some roughness in justice may be no bad thing. Certain of those elements of roughness in formal justice are inextricably bound up with other features of formal justice that are rightly deemed morally (...) important. The “fallacy of negative evidence” in historical scholarship is well exemplified by the assumption that In agro dominico, John XXII's bull condemning the errors of Meister Eckhart, was published only in the ecclesiastical province of Cologne. Scholarship on the subject has taken the limited publication of In agro dominico for granted on the grounds that nothing has been known to show that the bull was sent elsewhere. Seeing “nobody on the road,” some experts have even been able to see wording (...) in papal legislation that normal eyesight cannot find, namely, an explicit statement limiting the publication of the bull against Eckhart to the city, diocese, and province of Cologne. Were it true that John XXII restricted the publication of In agro dominico, then it might follow, as some recent scholars have maintained, that John wished to minimize the significance of Eckhart's trial and its outcome. After all, ever since the abandonment of the classical curriculum in the mid-nineteenth century, the courses of studies in American colleges have been characterized by ever-increasing diversity, responses to highly particular social and individual demands, spin-offs from traditional disciplines, specializations breeding subspecializations, and the like. Stringent counterrevolutions, such as the one undertaken in the College of the University of Chicago some thirty years ago, have been infrequent and brief. What, then, is so special about the present seductive disarray in literary (...) studies. Chiefly, I think, the importance of this compartmentation lies in the way we are encouraged to think of literary works and to respond to them. If we persuade ourselves that novels and plays and poems are written by members of an identifiable subgroup—whether that group be defined in national, ethnic, sexual, class, or special interest terms—and can be properly understood, and appreciated only by those who know the code of the same subgroup, we should be prepared to accept the implications of the position we are espousing. If, to cite a specific example, what is called the Black Aesthetic points to a mode of artistic apprehension that is not available to non-Blacks, it casts the rest of us, however curious and interested, in the roles of voyeurs and eavesdroppers. Here, as so often, our best writers anticipate and dramatize notions which become solemn critical propositions later on. In Saul Bellow's second novel, The Victim, published thirty years ago, the protagonist, Leventhal, recalls a party at which two of his friends, both Jewish, were singing spirituals and old ballads. They were being needled by a drunken New England WASP named Kirby Albee. "Why do you sing such songs?" he said. The work contains chapters on Whewell's theory of ideas, the fundamental principles of his philosophy of science, his views on mathematics and mechanics, and on his philosophy of induction and philosophy of discovery. In addition there is a chapter on the English reception of Whewell's thought. Professor Marcucci's notes are rich, both in references to Whewell's many critics and to nearly all of the extant (...) literature on Whewell.
